Here is an important ruling, the first in Italy, to recognize the responsibility of a social network (Facebook) for a violation that occurred even just through the so-called linking, or the publication of links to pages external to its own platform.
Facebook, despite requests from Mediaset to remove some links from a page, opened by anonymous users, which led to both content protected by copyright and illegally uploaded to YouTube, and to denigrating comments against a specific individual, did not remove the incriminating links and forced the business group to resort to the judiciary.
With the sentence n. 3512/2019 of the Court of Rome, the Judges condemned the most famous social network in the world for both defamation and infringement of copyright.
